(5MinNewsBreak.com) – In what sounds like a fair assessment of the Biden-Harris administration’s judicial actions toward Donald Trump, his attorney, Will Sharf, has blasted US Special Counsel Jack Smith for engaging in election interference through his superseding indictment against Trump.
Scharf, who spoke on Newsmax’s “Wake Up America,” contends that the timing of this indictment, coinciding closely with the commencement of early voting, constitutes election interference.
The Trump lawyer cited longstanding Department of Justice guidelines which advise against executing indictments or any significant investigative actions within 60 days of an election.
With the upcoming November 5 election 68 days away, and early voting starting soon, Scharf relayed Trump’s concerns posted on his Truth Social account about the proximity of these legal actions to the voting period.
“It is binding DOJ policy and has been for decades that you don’t bring an indictment, you don’t commit any overt investigative act within 60 days of a presidential election or any election, for that matter,” Scharf explained.
Scharf criticized Smith’s rush to push through the superseding indictment, suggesting desperation on Smith’s part following a Supreme Court decision on July 1 that significantly weakened his case by affirming presidential immunity for certain actions.
Despite modifications to the indictment to comply with this ruling, Scharf believes it still contains numerous issues, including several actions covered under presidential immunity, which he expects will not withstand legal scrutiny.
“There’s still a ton of presidential immune acts and evidence included in that indictment. I don’t think this will stand. I think President Trump is going to have the ability to run for president as he deserves undisturbed, to the extent possible by this entire campaign of lawfare,” Scharf stated.
He also shared his perspective as a former federal prosecutor, criticizing Smith’s approach as atypical and unprofessional, labeling him a rogue prosecutor.
The lawyer further dismissed the allegations against Trump as unfounded, pointing out a pattern of intense media coverage during indictment announcements, followed by a lack of substance as the cases are argued in court.
“What we’ve seen consistently is that on indictment day, the mainstream media breathlessly covers each of these cases. And then as we get into court and fight, they collapse like a house of cards,” Scharf said.
“When you look at the entire litigation portfolio here, President Trump is winning. The forces arrayed against him are losing and desperate. I think President Trump’s going to win in a landslide in November. I think then we can finally restore some semblance of normalcy to the rule of law and to legal processes in this country,” the lawyer concluded.
