(5MinNewsBreak.com) – In a shocking decision, the Supreme Court has upheld a gag order imposed on President-elect Donald Trump in his New York criminal case.
The gag order prevents Trump from making statements about jurors, court staff and their families.
Justice Samuel Alito handled the denial, marking this the second time the justices upheld restrictions this year.
The order was imposed before Trump’s May conviction on 34 felony counts related to allegedly falsifying business records from hush money payments to Stormy Daniels.
Judge Juan Merchan, who presides over the case, had partially lifted the gag but kept it to protect court personnel and jurors.
Trump’s legal team argued that these restrictions violate his First Amendment rights by muzzling Trump’s ability to defend himself in the court of public opinion.
While some parts of the order were pared back, Merchan claimed he needed to protect jurors from potential harassment or threats.
The President-elect’s attorneys argued that these remaining restrictions infringe on his constitutionally protected right to free speech – a cornerstone of American democracy that seems increasingly under threat.
Missouri Attorney General Andrew Bailey attempted to challenge the gag order on behalf of concerned voters in Missouri.
Trump’s attorneys also cited Joe Biden’s own words in the case criminal case against his son Hunter.
Joe said Hunter had been “selectively, and unfairly, prosecuted” and that “raw politics has infected this process.”
Trump’s lawyers argued that Joe’s own words could be used and affect the criminal case in New York.
Biden’s admission underscores the clear weaponization of the justice system against a political opponent in a dangerous precedent for American democracy.
Although Judge Merchan has delayed Trump’s sentencing to consider arguments about presidential immunity from criminal prosecution, the very existence of this case raises serious questions about the motivations behind it.
🚨Supreme Court Won't Lift Gag Order on Donald Trump
Trump is prohibited from speaking about jurors, witnesses, prosecutors, court staff or members of their family.
It does not bar him from speaking about Merchan or Manhattan District Attorney Alvin Bragg.— Marcy (@pratte3060) December 10, 2024
