While an activist judge demands sensitive information about deportation flights to El Salvador, administration officials are protecting America’s diplomatic interests and security protocols.

U.S. District Judge James Boasberg has been investigating whether the government ignored his order to halt deportations of illegal aliens, particularly those with ties to the dangerous Tren de Aragua gang.

The judge demanded detailed information about deportation flights, including flight manifests and the number of people transferred, a request that administration officials have resisted on national security grounds.

The Trump administration exerted executive authority by formally invoking the state secrets privilege to withhold information on deporting Venezuelan aliens to El Salvador under the Alien Enemies Act.

This legal privilege allows the government to deny disclosure of information in legal proceedings if revealing such data could compromise national security.

The administration’s filing argues that “further intrusions on the Executive Branch would present dangerous and wholly unwarranted separation-of-powers harms with respect to diplomatic and national security concerns that the Court lacks competence to address.”

Top Department of Justice officials signed the document and supported by Secretary of State Marco Rubio and Secretary of Homeland Security Kristi Noem.

“The information sought by the Court is subject to the state secrets privilege because disclosure would pose reasonable danger to national security and foreign affairs,” stated the Trump administration in its filing.

U.S. Deputy Attorney General Todd Blanche informed Boasberg that invoking the privilege “is a serious matter that requires careful consideration of national security and foreign relations, and it cannot properly be taken in just 24 hours.”

The administration is seeking to overturn Boasberg’s order temporarily halting the deportations, arguing that the court already has sufficient facts to address compliance issues.

The case centers on whether the Trump administration violated an emergency restraining order blocking deportations under the 1798 wartime law.

This development comes after a plane carrying illegals, including Venezuelan nationals, arrived in El Salvador.

The Alien Enemies Act, a 226-year-old law, gives the president broad authority to remove foreign nationals considered threats to national security during wartime or threatened invasion.

While liberal activists and Democrat-appointed judges have criticized the deportation efforts, El Salvador President Nayib Bukele had a simple response after receiving the flight of criminal suspects: “Oopsie, too late.”

The administration provided a declaration from a regional ICE officer about the deportations, which Boasberg deemed insufficient.

However, government lawyers have consistently maintained that revealing additional information about the flights would compromise national security interests.

The Trump administration’s decisive action demonstrates its commitment to protecting American citizens from dangerous foreign criminals while respecting the constitutional separation of powers.
