An unelected official is trying to undermine the Trump administration and dictate how the federal government acts from the bench.
Specifically, a federal judge appointed by Joe Biden has blocked President Donald Trump’s overhaul of the Department of Health and Human Services (HHS).
The judge halted plans to streamline operations and reduce waste by cutting 10,000 bureaucrats from the payroll.
U.S. District Judge Melissa DuBose issued an injunction, stopping the Trump administration’s strategic plan to transform HHS by consolidating 28 divisions into 15 and closing half of its regional offices.
Initiated by HHS Secretary Robert F. Kennedy Jr., the restructuring is part of President Trump’s broader initiative to improve government efficiency.
The judge’s ruling came after 19 Democrat-led states and Washington, D.C., filed a lawsuit challenging the administration’s authority to implement these changes.
Judge DuBose sided with the blue states and claimed the Executive Branch lacks authority to reorganize agencies created by Congress.
Kennedy had clearly articulated the purpose behind the restructuring: “We are realigning the organization with its core mission and our new priorities in reversing the chronic disease epidemic.”
Despite the judge’s ruling, the Trump administration remains committed to its vision of streamlining government operations.
HHS spokesperson Andrew Nixon stated that the department “remains committed to modernizing a health workforce that for too long prioritized institutional preservation over meaningful public health impact.”
He also confirmed the department is reviewing the decision and considering next steps.
The lawsuit claimed that the restructuring would harm healthcare services. The Trump administration’s plan aimed to refocus resources on actual health priorities rather than maintaining unnecessary positions.
Democrats celebrated the ruling, with New York Attorney General Letitia James praising the decision.
The court ordered the Trump administration to file a compliance report by July 11, while also insinuating the administration might be slow to comply with the injunction.
This judicial intervention represents yet another example of activist judges obstructing President Trump’s America First agenda and attempts to drain the Washington swamp.
The administration’s efforts to “refocus a sprawling bureaucracy that, over time, had become wasteful, inefficient, and resistant to change” will continue despite this temporary setback as they explore legal options to implement these necessary reforms.
